Two grounds, one ridge
The South Fork is really two landscapes stitched together at Montauk Highway. South of it, most of the peninsula sits on outwash plain: sand and gravel washed out ahead of the last glacier, its type soil named Bridgehampton silt loam after the hamlet where the USDA first mapped it in 1928 — well drained on top and, in the agency's own words, "commonly saturated in the lower part in winter, spring, and after heavy rains." North of the highway, and again at Montauk, the ground is moraine: the ridge of glacial till the ice sheet left behind, full of boulders, clay lenses and real slope. Springs, Northwest Woods, North Sea, the Shinnecock Hills, Sag Harbor village, north Bridgehampton, Stony Hill, Water Mill's Deerfield Road side and Montauk's hills are all moraine; Wainscott's and Sagaponack's fields, the Southampton estate section, and most land toward Mecox Bay and Georgica Pond are outwash. A wall on one ground is not solving the same problem as a wall on the other.
What each ground asks of a wall
On outwash sand, the ground drains almost too well until the water table intervenes: near the bays and ponds it can sit 2 to 8 feet below grade, close enough to turn a wall's backfill into a wet sponge and put real hydrostatic pressure on anything holding soil above it. On the moraine, clay lenses trap water instead of passing it, so a wall built into a hillside without a drain behind it holds back a slope that never dries out the way sandy ground nearby does. Neither ground is easier; they fail differently, and a mason who knows which one they are standing on before pricing the job is worth the extra question.

A typical 50-foot, 3-foot wall runs $4,000–12,000 in concrete block and $6,000–18,000 in natural stone. These are national figures — no Long Island-specific price exists — and Hamptons labor and access tend to push a job toward the top of each range. No source prices the drainage package (pipe, gravel, geogrid) as its own line item, which is one reason a quote near the 4-foot line jumps sharply: the engineering and drainage are what you are paying for, not extra stone.
Drainage is the wall
A retaining wall does not fail because the stone is weak; it fails because water gets behind it and pushes. The fix is the same on either ground: a free-draining gravel zone behind the wall face, a perforated pipe at the base daylighted downhill, and, above the code line below, geogrid tied back into the slope in layers as the wall rises. Skip the drain and the wall becomes a dam; the first wet spring finds out. A "surcharge" is the other term worth knowing: any load behind the wall beyond level, undisturbed ground — a driveway, a parked car, a pool, a slope, a house. A wall holding a surcharge is regulated more strictly than its height alone suggests.
The two legal thresholds, and they are not the same threshold
The permit line. New York's residential code treats a retaining wall not over 4 feet high, measured from the bottom of the footing to the top of the wall, as exempt from a building permit — unless it carries a surcharge or holds back liquid. A wall under 4 feet that holds up a driveway cut still needs a permit, because the driveway is the surcharge.
The engineering line. Section R404.4 requires a registered design professional's stamped design, to a 1.5 safety factor against sliding and overturning, for any wall retaining more than 48 inches of unbalanced fill, or any wall over 24 inches resisting lateral loads beyond the soil itself. In practice, most walls near the 4-foot mark end up engineered regardless of the permit exemption.
Footings and frost depth
One number this guide will not give you: how deep a wall's footing must go to clear frost. Sources disagree on the figure for Long Island, and none is confirmed against a Suffolk County, East Hampton or Southampton text, so we do not print one — ask the building department before the footing is dug.
What that adds to the calendar
Stamped drawings, when the wall needs them, take 1–2 weeks on their own. Then the permit clock starts: the Village of East Hampton usually issues in 2–4 weeks once an application is complete; the Town of East Hampton reported a 16–20 week backlog in 2026 against its own 15-day statutory target. A wall under 4 feet and without a surcharge is 3–5 days of labor; an engineered, permitted wall runs 2–4 weeks or more from first shovel to final inspection, before the paperwork ahead of it. Cold weather adds its own stop: mortared walls pause below 40°F unless materials are heated and the work is protected for 24 to 48 hours after; segmental block and dry-stacked stone can continue through winter if the ground is not frozen. Clearing trees or brush to build the wall raises a separate question: the Town of East Hampton's clearing limits are being actively rewritten as of 2026, so ask before cutting anything on a wooded moraine lot.
Water, wetlands and the ponds
A wall within reach of a wetland is regulated as a structure. In the Town of East Hampton that means a 100-foot no-build setback from a wetland's upland edge and Natural Resources Special Permit review within 150 feet — a review that touches roughly three-quarters of the town's planning applications. In the Town of Southampton, Chapter 325 sets structures back 125 feet (100 on already-developed lots "where practicable"), turf and fertilizer 100 feet, and sanitary systems 150 feet. New York State adds a 300-foot "adjacent area" around any tidal wetland. Georgica Pond, Mecox Bay and Sagg Pond carry one more layer: the Town Trustees, separate from the Town Board in both towns. We found no pond-specific numeric setback beyond these general rules, so treat a wall near one of those ponds as a permit conversation from the first sketch.
Historic districts don't exempt the ground, or the wall
The Sag Harbor Village Historic District's review board names retaining walls explicitly in its scope, alongside sidewalks, aprons, terraces and curbing: a Certificate of Appropriateness is required before the building permit for anything visible from a street or neighbor, engineering requirement or not. Inside the Village of East Hampton's four historic districts, walls and fences need Design Review Board approval; outside them, a wall set back 50 feet or more from the pavement can rise to 8 feet without the same review.
A short field guide by ground
- On the moraine (Springs, Northwest Woods, North Sea, Shinnecock Hills, Sag Harbor village, north Bridgehampton, Stony Hill, Deerfield Road, Montauk's hills): expect clay lenses that hold water, boulders already on site a mason may reuse, and a real chance the wall needs an engineer regardless of height once it holds a driveway cut.
- On the outwash plain (Wainscott's and Sagaponack's fields, the Southampton estate section, most land toward Mecox and Georgica): expect fast top-side drainage that reverses a few feet down, a shallow water table near any pond or bay, and setbacks that reach further inland than the property line suggests.
- Near a pond with Trustee jurisdiction (Georgica, Mecox, Sagg): a wall is a multi-agency permit question before it is a stone question — start that conversation before the design is finished, not after.
